1. Introduction and Acceptance of Terms

Welcome to NationsBase (“we,” “our,” “us”).

By accessing or using our website, mobile application, or any related services (collectively the “Platform”), you agree to be legally bound by these Terms & Conditions and our Privacy Policy.

If you do not agree, please discontinue use of the Platform.

NationsBase operates as an independent online community platform, enabling immigrants to connect with compatriots, local businesses, and information resources. We provide infrastructure only and are not the creator, publisher, or guarantor of user content.

2. Services Provided

NationsBase offers users access to:

  • Community spaces for cultural and social interaction,
  • Listings of compatriot-owned businesses and services,
  • Educational and immigration-related resources,
  • Communication tools for networking and events.

All services are provided on an “as-is” and “as-available” basis.

We may modify, suspend, or discontinue any part of the Platform at any time without notice.

3. User Responsibilities

When using NationsBase, you agree to:

  • Provide accurate and truthful information.
  • Not misuse the Platform, including:
    • posting unlawful, defamatory, discriminatory, or offensive content;
    • spamming, phishing, or spreading malware;
    • impersonating others or violating third-party rights.
  • Respect the privacy of others and refrain from publishing personal data without consent.
  • Comply with applicable laws of Germany and the European Union.

You are solely responsible for all content, data, and materials you upload or share through NationsBase.

4. Nature of the Platform and User-Generated Content

NationsBase is an intermediary hosting provider under § 10 Telemediengesetz (TMG) and Article 14 of the EU eCommerce Directive 2000/31/EC.

This means:

  • We do not monitor or pre-approve user submissions.
  • We are not liable for user-generated content unless we obtain actual knowledge of illegal material and fail to act promptly (“Notice-and-Takedown” principle).
  • Users remain the data controllers of any personal or business information they share publicly.

5. Intellectual Property

All software, design, trademarks, and proprietary materials of NationsBase are protected under international copyright and trademark laws.

You may not copy, modify, distribute, sell, or lease any part of the Platform or create derivative works without our written consent.

However, users retain ownership of their own content (e.g., listings, posts, comments) but grant NationsBase a non-exclusive, worldwide, royalty-free license to host, display, and distribute such content as necessary for operation of the Platform.

6. Third-Party Links and Integrations

The Platform may contain links or integrations with third-party websites, services, or advertisements.

NationsBase is not responsible for:

  • the content, accuracy, or policies of external websites,
  • cookies or data collected by external providers (see Cookie Policy),
  • transactions or communications conducted outside the Platform.

Access to third-party services is at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law:

  • NationsBase, its founders, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the Platform.
  • We do not guarantee the accuracy, completeness, or reliability of user-generated information, listings, or external data.
  • NationsBase’s total liability for any claim shall not exceed €100 or the amount you paid (if any) for use of the service.

This limitation does not affect liability for willful misconduct, gross negligence, or mandatory consumer rights under German law.

8. Account Suspension and Termination

We reserve the right to:

  • Suspend or delete accounts that violate these Terms, applicable laws, or community guidelines;
  • Remove content deemed unlawful or harmful;
  • Deny access temporarily or permanently to preserve platform integrity.

Users may delete their own accounts at any time via account settings or by contacting [email protected].

9. Indemnification

You agree to indemnify and hold harmless NationsBase, its affiliates, and representatives from any claims, damages, or expenses (including legal fees) arising from:

  • Suspend or delete accounts that violate these Terms, applicable laws, or community guidelines;
  • Remove content deemed unlawful or harmful;
  • Deny access temporarily or permanently to preserve platform integrity.

10. Changes to the Terms

We may update these Terms periodically to reflect legal or operational changes. The current version is always available at https://nationsbase.com/terms.

If significant modifications occur, we will notify users via email or in-app message.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law provisions.

Place of jurisdiction for disputes shall be Hamburg, Germany, unless mandatory consumer protection laws provide otherwise.
